Terms of Service

These Terms of Service ("Terms") govern your use of Skeptik. Skeptik is operated by EADS Ventures L.L.C. ("Skeptik", "we", "us"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Skeptik analyzes online marketplace listings and provides an informational risk assessment, including a rating and supporting observations, based on signals available at the time of analysis. The Service is a decision-support tool. It is not a guarantee, an appraisal, an authentication service, or professional advice.

2. Eligibility and accounts

You must be at least 16 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your login credentials, and for all activity under your account. Notify us promptly of any unauthorized use.

3. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any third party's rights.
• Scrape, crawl, resell, sublicense, or provide access to the Service in a way not expressly permitted, or exceed reasonable usage.
• Access the Service through automated means except as we expressly authorize.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service, its systems, or other users' data.
• Reverse engineer or attempt to extract the source code of the Service except to the extent that restriction is prohibited by law.
• Misrepresent the output of the Service or use it to harass, defame, or harm any seller or other person.

4. Free and paid plans

We offer a free tier with a limited number of analyses and one or more paid subscription plans. We may change the features, limits, or pricing of any plan, and we will provide notice of material changes as required by law.

5. Billing and cancellation

Paid subscriptions are billed in advance on a recurring basis through our payment processor, Stripe, until cancelled. By subscribing, you authorize us and Stripe to charge your payment method for the applicable fees and taxes. You can cancel at any time through the billing portal. Cancellation takes effect at the end of the current billing period. Except where required by law, fees already paid are non-refundable.

6. Third-party marketplaces and content

The Service analyzes listings hosted on third-party marketplaces. We are not affiliated with, endorsed by, or responsible for those marketplaces or for the sellers, listings, or content on them. Your dealings with any seller or marketplace are solely between you and them. Marketplace names and trademarks are the property of their respective owners.

7. Informational purpose and no warranty

Skeptik ratings and observations are opinions generated from limited, changeable information and may be incomplete or incorrect. The Service does not guarantee that any listing is safe, fraudulent, authentic, defect-free, or fairly priced. See our Disclaimer. The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

8. Limitation of liability

To the fullest extent permitted by law, Skeptik and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or purchasing losses, arising out of or relating to your use of, or inability to use, the Service, even if advised of the possibility. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred US dollars.

9. Indemnification

You agree to indemnify and hold harmless Skeptik from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

10. Intellectual property

The Service, including its software, design, and content we create, is owned by Skeptik and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal, non-commercial purposes in accordance with these Terms.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive termination will survive.

12. Changes to the Service or Terms

We may modify the Service or these Terms. When we make material changes to these Terms, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws of [State/Country], without regard to conflict-of-laws rules. Any dispute will be resolved in the courts located in [Venue], and you consent to their jurisdiction, unless a binding arbitration or other dispute-resolution provision is added following legal review.
